OWNERSHIP DECLARATION CLAUSE

By selecting Owned Cat Surrender, I declare that:

• I am the legal owner of the cat(s) described above or I am legally authorized to surrender this cat.

• The cat is not stolen, lost, or subject to any ownership dispute.

• No other individual, shelter, rescue, or organization has a legal claim to this cat.

• I permanently and immediately transfer ownership to Michelle’s Kitten Rescue, with no right to reclaim the cat.

EMERGENCY SURRENDER CLAUSE

By selecting Emergency Surrender, I acknowledge and agree that:

• This surrender is being completed due to an urgent situation, which may include but is not limited to:

  • Medical emergency

  • Risk to the cat’s immediate welfare

  • Unsafe living conditions

  • Owner hospitalization, eviction, or crisis circumstances

• I understand that emergency intake does not guarantee treatment, placement, or outcome, and decisions will be made based on the cat’s condition, available resources, and veterinary assessment.

• This is not temporary help, short-term care, boarding, or a medical hold.

• I permanently and immediately transfer ownership to Michelle’s Kitten Rescue, with no right to reclaim the cat.

FOUND / STRAY CAT SURRENDER CLAUSE

By selecting Found / Stray Cat Surrender, I declare that:

• I am not claiming ownership of this cat.

• To the best of my knowledge, the cat was found as a stray or abandoned.

• I have not knowingly withheld ownership information.

• I understand that under Ontario law, Michelle’s Kitten Rescue may:

  • Attempt to locate an owner if reasonably possible, or

  • Take full custody of the cat for veterinary care, foster placement, and adoption.

• I acknowledge that once surrendered, I have no ownership rights or claim to the cat, even if an owner is later identified.

MEDICAL & BEHAVIOURAL DISCLOSURE

To the best of my knowledge, I have fully disclosed:

• All known medical conditions

• Medications, injuries, or prior illnesses

• Behavioral concerns (including aggression, biting, spraying, or fear issues)

  
  

I understand that failure to disclose known information may endanger people, animals, or foster homes.

TRANSFER OF OWNERSHIP

PLEASE READ CAREFULLY: Once this form is submitted, ownership of the cat(s) is permanently transferred and cannot be reversed for any reason.

I hereby voluntarily and permanently surrender all rights, ownership, and interest in the cat (s) described above to Michelle’s Kitten Rescue.

AUTHORIZATION OF CARE

I authorize Michelle’s Kitten Rescue to:

• Seek veterinary care, including emergency treatment

• Spay or neuter the cat if required

• Vaccinate, microchip, treat, foster, transfer, or adopt out the cat

• Make all decisions deemed necessary for the cat’s welfare

NO GUARANTEE OF OUTCOME

I understand and acknowledge that:

• Adoption is not guaranteed

• The cat may be placed with another rescue or foster

• In cases of severe illness, injury, or suffering, humane euthanasia may be necessary, as determined by a licensed Ontario veterinarian

IRREVOCABLE EMERGENCY SURRENDER

I understand that an emergency surrender is not a temporary placement or boarding arrangement. By surrendering this cat, I permanently and irrevocably transfer ownership to Michelle’s Kitten Rescue, regardless of the cat’s medical outcome, recovery, or improvement in condition.

NO RECLAIM AFTER MEDICAL TREATMENT

I acknowledge that once veterinary care, diagnostics, surgery, or treatment has been authorized or initiated by Michelle’s Kitten Rescue, I permanently forfeit any right to reclaim the cat, even if I later offer to reimburse costs or disagree with the rescue’s decisions.

USE OF DONATED AND VOLUNTEER FUNDS

I understand that medical care may be funded through volunteer donations, fundraising, or rescue resources, and that such funds are provided for the benefit of the cat, not for the restoration of ownership to a former owner.

NO RESTORATION OF OWNERSHIP THROUGH PAYMENT

I understand that payment, partial payment, or an offer to reimburse veterinary costs does not restore ownership or create any right to reclaim the cat.

FALSE CLAIMS AND PUBLIC STATMENTS

I acknowledge that knowingly making false or misleading public statements alleging theft, misconduct, or wrongdoing by Michelle’s Kitten Rescue may constitute defamation or misrepresentation under Ontario law.

PHOTO & MEDIA CONSENT

I consent to Michelle’s Kitten Rescue taking and using photos or videos of the surrendered cat for adoption listings, social media, website, or fundraising purposes. No personal identifying information will be shared publicly.

RELEASE OF LIABILITY (ONTARIO)

I release and forever discharge Michelle’s Kitten Rescue, its volunteers, foster homes, directors, and affiliates from any and all liability, claims, or damages arising after surrender, including but not limited to:

• Medical outcomes

• Behavioral issues

• Decisions made in the cat’s best interest

This release applies to the fullest extent permitted under the laws of the Province of Ontario.

This document constitutes the entire agreement between the parties. No verbal statements, text messages, or prior discussions alter the terms of this agreement. Please type the following statement exactly as written:

DIGITAL ACKNOWLEDGEMENT & SIGNATURE

By submitting this form electronically, I confirm that:

• I have read and understood this agreement in full

• All information provided is truthful and complete

• I am legally authorized to surrender this cat

• I confirm that I understand this surrender is permanent, that I will not get the cat back under any circumstances, and that this agreement is final.

• My electronic submission constitutes a legally binding signature under Ontario law
