PURPOSE OF AGREEMENT

Michelle’s Kitten Rescue (the “Rescue”) agrees to place the following animal(s) into the temporary care of the Foster Caregiver:

This Agreement does not transfer ownership under any circumstances.

OWNERSHIP

All foster homes agree, and understand, that the animal(s) in their care belong to Michelle's Kitten Rescue and are not the property of the foster home. All decisions made regarding the animal(s) vet care, final placement etc. will be made by the Rescue (although input from fosters is always welcome). The foster home will immediately inform the Rescue if the animal is lost or stolen, and the foster home may not transfer the animal to any other person without express written consent from the Rescue

1.BASIC CARE & ENVIRONMENT

Indoor Living Requirement

Foster animal(s) shall live indoors only as companion animals.

They are never to be housed outdoors or allowed unsupervised outdoor access.


Safe & Clean Environment

The Foster agrees not to expose the animal(s) to:

  • Toxic substances

  • Harmful chemicals

  • Cleaning agents or poisons

  • Unsafe animals

  • Hazardous objects

  • Any condition that endangers health or safety

A clean environment is mandatory.


If an animal is sick (including vomiting or diarrhea):

  • Bedding must be changed promptly and frequently

  • Floors must be cleaned and disinfected

  • Litter boxes must be cleaned daily and remain accessible


Feeding & Daily Care

  • Animals may free-feed unless otherwise directed by MKR

  • Fresh, clean water must be available at all times

  • Litter pans must be scooped daily

  • Foster animals must receive daily socialization and supervision


Other Pets & Quarantine

Foster animals must be quarantined separately from resident pets as directed by MKR.

Only MKR will determine when integration is permitted.

Before welcoming new foster animal(s), all reusable supplies must be thoroughly cleaned and sanitized.

Failure to follow quarantine protocol may result in termination of this Agreement.

2.MEDICAL / VETERINARY CARE


Michelle’s Kitten Rescue (MKR) covers approved veterinary care, including vaccines, spay/neuter, preventative care, and treatment for known medical conditions.


Fosters must contact MKR and receive approval before any vet appointment, treatment, or medication.


In a true life-threatening emergency, the foster may seek immediate care to stabilize the animal. MKR must be notified as soon as possible.


If veterinary care is obtained without prior approval (non-emergency), the Foster assumes full financial responsibility for all related costs.

Emergency Situations

In the event of a medical emergency:

  • The Foster must attempt to contact MKR immediately.

  • If immediate care is required to prevent suffering or death, emergency stabilization may be sought.

  • MKR must be notified as soon as reasonably possible.

MKR reserves the right to determine financial responsibility for any treatment obtained beyond emergency stabilization without authorization.


Foster Financial Responsibility

The Foster will be responsible for veterinary costs if injury or illness occurs due to:

  • Negligence

  • Failure to follow quarantine or care guidelines

  • Unsafe housing conditions

  • Exposure to preventable hazards

  • Unauthorized medical treatment

MKR retains sole discretion in determining whether a breach has occurred.

3.TRANSFER OF CUSTODY PROHIBITED


Foster animal(s) may not be transferred, boarded, surrendered, rehomed, or placed in the care of any other person or organization without prior written approval from MKR.

This includes temporary care arrangements.

Unauthorized transfer constitutes a material breach of this Agreement and may result in immediate termination and legal action.

4.RIGHT TO REMOVE ANIMAL WITHOUT NOTICE

MKR reserves the right to remove any foster animal from the Foster Home at any time, with or without prior notice, if MKR determines that:

  • The animal’s health or safety may be at risk

  • The terms of this Agreement have been violated

  • The foster environment is deemed unsuitable

  • Communication has significantly broken down

The Foster agrees to immediately surrender the animal(s) upon request.

5.NEGLECT / VIOLATION & TERMINATION CLAUSE


This Agreement may be terminated immediately if MKR determines that:

  • Terms of this Agreement have been violated

  • The animal’s welfare is compromised

  • Medical concerns have been withheld

  • The animal has been transferred without authorization

  • There is evidence of neglect, improper care, or misrepresentation

Upon termination, the Foster must immediately return the animal(s) and all Rescue property.

MKR reserves the right to pursue legal remedies as permitted under Ontario law, including but not limited to:

  • Recovery of the animal(s)

  • Recovery of Rescue property

  • Reimbursement of veterinary or recovery costs

  • Civil legal action where necessary

MKR retains sole discretion in determining breach of contract.

6.NOTICE TO CEASE FOSTERING

If a Foster wishes to discontinue fostering, a minimum of seven (7) days written notice must be provided to MKR.

During this period:

  • Proper care must continue

  • The Foster must cooperate with transition arrangements

  • The animal(s) may not be relocated without MKR approval

MKR understands emergencies may arise and will work with fosters in good faith. However, failure to provide reasonable notice may impact future fostering eligibility.

7 .SUPPLIES & RESCUE PROPERTY

All supplies provided by MKR remain the property of the Rescue. This includes, but is not limited to:

  • Food

  • Litter

  • Carriers

  • Crates

  • Bowls

  • Medical supplies

If fostering ends for any reason — including adoption — all unused supplies must be returned promptly, including any remaining food and litter, regardless of quantity.


Failure to return Rescue property may result in reimbursement requirements.

Before welcoming additional foster animal(s), all reusable supplies must be thoroughly cleaned and sanitized to prevent the spread of illness.

8.LIABILITY

The Foster understands:

  • Animals are unpredictable

  • MKR makes no guarantees regarding health or temperament

  • The Foster assumes responsibility for damages caused during the foster period

  • MKR is not liable for injury or property damage

9 .SOCIAL MEDIA & PROMOTION


The Foster agrees to provide clear photos and a written bio accurately describing personality and behavior within seven (7) days of intake.


This applies to all foster cats, including those not yet medically cleared or ready for adoption.

Photos and updates may be used by MKR for website listings, social media promotion, fundraising, and adoption efforts.

Fosters may not independently advertise, promise, or represent the animal(s) as available for adoption outside of MKR.
